1. About these terms
These terms apply to your use of the Go Shortstay website at www.goshortstay.co.nz, to our online booking site at book.goshortstay.co.nz, and to any booking you make with us directly. Please read them before you use the site or make a booking. By using the site or making a booking, you agree to these terms.
We may change these terms from time to time. The version that applies to your booking is the version published when you make the booking.
In these terms, we, us and our mean Go Short Stay Limited (NZBN 9429048904131), part of the Staircase Group. You means the person using the site or making a booking. Property means a property we offer for short-stay accommodation. Owner means the owner of a Property.
2. Who we are and what we do
Go Short Stay Limited manages and lets short-stay and holiday accommodation on behalf of property owners. We arrange bookings, guest communication, payment, cleaning and property care. In providing the accommodation we act as agent for the Owner, and we manage your booking and stay.
Short-stay accommodation booked through us is holiday or transient accommodation. It is not a residential tenancy, and the Residential Tenancies Act 1986 does not apply. You do not acquire any tenancy or other right to occupy beyond the dates and terms of your booking.
3. Using this website
You may use the site to browse Properties, make bookings and manage your stay. You must give accurate information and use the site lawfully.
You must not misuse the site, interfere with it, attempt to gain unauthorised access, or use it to send spam or harmful code.
Property descriptions, photographs and prices are provided in good faith and are indicative. Small differences can occur between the listing and the Property. If information is materially wrong we will correct it, and your consumer rights in clause 12 still apply.
4. Bookings and your accommodation contract
You can book with us directly through our online booking site at book.goshortstay.co.nz. When you make a booking and we confirm it, a contract is formed between you and us on these terms and on the specific terms shown at the time of booking, including the rate, cancellation policy and house rules for that Property.
The person who makes the booking (the lead guest) must be at least 18 years old and is responsible for the booking, for payment, and for every member of the party complying with these terms and the house rules.
A booking is confirmed only when you receive a written confirmation from us. If we cannot accept a booking, we will tell you and refund any payment you have made.
5. Prices, payment and fees
Prices are in New Zealand dollars and include GST where it applies. The price shown at booking includes the nightly rate and any fees we tell you about, such as cleaning or service fees. Optional extras are additional.
We will tell you when payment is due. Depending on the Property and rate, we may take full payment at the time of booking, or a deposit followed by the balance before check-in. Payment is processed by our third-party payment provider.
If a payment is not made when due, we may treat the booking as cancelled by you and apply the cancellation terms in clause 7.
6. Security deposits and damage
For some Properties we take a refundable security deposit, or a pre-authorisation on your card, before or at check-in. This is not a bond under the Residential Tenancies Act 1986.
We may deduct from the security deposit, or charge you, the reasonable cost of putting right: damage beyond fair wear and tear; extra cleaning needed because of the state the Property was left in; missing items; or losses caused by a breach of these terms or the house rules. We will give you a breakdown of any deduction.
We refund the balance of the security deposit, or release the pre-authorisation, within a reasonable time after check-out once the Property has been checked.
7. Changes and cancellations by you
The cancellation and refund policy that applies to your booking is the one shown for that booking before you pay. It varies by Property and rate, and for bookings made through a third-party platform it is set by that platform. The policy shown at the time of booking forms part of your contract with us, so please read it before you confirm.
If you want to change your dates, tell us as early as you can. We will try to help, but we cannot guarantee a change, and a different price may apply.
If you have to cancel because of a genuine emergency or an event outside your control, please contact us. We will act reasonably, look at your circumstances, and meet our obligations under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
8. Changes and cancellations by us
Occasionally we may need to change or cancel a booking, for example if a Property becomes unavailable or unsafe, or an Owner ends our management of it. If this happens we will tell you as soon as we can and will offer either a suitable alternative or a full refund of amounts you have paid for the affected booking.
Except where your consumer rights require more, a suitable alternative or a full refund is the limit of what we owe you if we change or cancel in these circumstances.
9. Your responsibilities as a guest
You and your party must:
• treat the Property and its contents with care;
• keep to the maximum number of guests stated in your booking;
• not hold parties or events without our written agreement;
• keep noise reasonable and respect neighbours;
• follow any body corporate rules, council rules and the house rules for the Property; and
• comply with any smoking, pet and vehicle restrictions.
You must not use the Property for anything unlawful, and you must let us know promptly about any damage or fault.
If you or your party seriously breach these terms or the house rules, or behave in a way that puts people or the Property at risk, we may end your stay. Where we reasonably do so, you may not be entitled to a refund for the remaining nights, subject to your consumer rights in clause 12.
10. Occupancy, check-in and check-out
Check-in and check-out times are shown in your booking. Please keep to them so the Property can be cleaned and prepared for the next guests. Late check-out may incur an extra charge if it has not been agreed.
Only the guests named or numbered in your booking may stay at the Property overnight.
11. Bookings made through other platforms
You can also book our Properties through third-party platforms such as Airbnb, Booking.com and VRBO. If you book through one of those platforms, that platform’s terms and cancellation policy apply to your booking, in addition to the house rules for the Property, and payment and cancellations are handled through that platform. These website terms apply to bookings you make with us directly.
12. Your consumer rights
If you are a consumer, the Consumer Guarantees Act 1993 gives you guarantees about the services we supply, including that they will be carried out with reasonable care and skill and be reasonably fit for purpose. The Fair Trading Act 1986 also protects you from misleading or deceptive conduct.
Nothing in these terms limits or excludes your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If anything in these terms is inconsistent with those Acts, those Acts prevail.
If you book in trade and for business purposes, the parties agree that the Consumer Guarantees Act 1993 does not apply, to the extent allowed by section 43 of that Act and where it is fair and reasonable to agree this.
13. Our liability
We take care to describe and prepare our Properties accurately and to provide our services with reasonable care and skill.
Except for guarantees and rights that cannot be excluded by law (including under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986), and to the extent the law allows:
• we are not liable for loss or damage that was not reasonably foreseeable, or for indirect or consequential loss;
• we are not liable for loss of, or damage to, your belongings at a Property, except where it is caused by our failure to take reasonable care; and
• where we are liable, our total liability for a booking is limited to the amount you paid us for that booking.
Nothing in this clause applies to liability that cannot be limited or excluded by law, including liability for personal injury caused by negligence.
14. Events outside our control
We are not responsible for failing to meet an obligation if it is caused by something outside our reasonable control, such as a natural disaster, severe weather, fire, flood, utility or network failure, government action, or a public health measure. If such an event affects your booking we will contact you, and where the law requires or where it is fair to do so, we will offer a suitable alternative or a refund.
15. Privacy
We handle your personal information in line with the Privacy Act 2020 and our Privacy Policy at www.goshortstay.co.nz/privacy. Please read it to understand what we collect and how we use and share it.
16. Intellectual property
The content on this website, including text, images, logos and design, belongs to us or our licensors and is protected by law. You may view and use it to make a booking or use our services, but you must not copy, reproduce or use it for other purposes without our permission.
17. Complaints and disputes
If something is not right during your stay, please tell us straight away so we can put it right. You can also raise a complaint with us at admin@goshortstay.co.nz or 03 265 1222.
If we cannot resolve a dispute, it can be dealt with in the New Zealand courts or, for many consumer claims, the Disputes Tribunal. These terms are governed by New Zealand law.
18. General
If part of these terms cannot be enforced, the rest still applies.
We may transfer our rights and obligations under these terms to another company in our group, or to a business that takes over our operations, and your rights will not be affected.
A delay in enforcing these terms is not a waiver of our rights.
These terms, together with the specific terms shown at booking, are the whole agreement between you and us about your use of the site and your booking.
